Welcome to HRVfit. These Terms of Service (“Terms”) govern your access to and use of www.hrvfit.com.au, our programs, coaching, products and related services (together, the “Services”). By accessing or using the Services, you agree to these Terms and our Privacy Policy.

If you do not agree, do not use the Services.

2. Eligibility & accounts

  • You must be at least 16 years old (or the age of digital consent in your state) to use the Services. If under 18, you confirm you have parental/guardian consent.

  • You are responsible for your account credentials and all activity under your account. Tell us immediately if you suspect unauthorised access.

3. Health disclaimer (important)

  • HRVfit provides general fitness and performance information only. We do not provide medical, physiotherapy or dietetic advice.

  • Training carries risks. By using the Services, you confirm you’re in suitable health, and you’ll consult a qualified health professional before starting any new program—especially if you have injuries, medical conditions, are pregnant, or take medications.

  • Stop any exercise that causes pain, dizziness or shortness of breath and seek professional advice.

4. Not a guarantee of results

Performance outcomes vary between individuals. We do not guarantee specific performance improvements, race results, body composition changes or timelines.

5. Purchases, pricing & billing

  • Prices are in AUD and include GST where applicable. We may change pricing at any time (changes won’t affect already-paid periods).

  • You authorise us and our payment processor to charge your selected payment method for one-off purchases, subscriptions or instalments, including applicable taxes.

  • If a payment fails, we may suspend access until the payment is resolved.

6. Subscriptions & renewals

  • If you purchase a subscription, it will auto-renew at the end of each billing period unless you cancel before renewal.

  • You can cancel via your account or by contacting us; your access continues until the end of the paid period.

  • To the extent permitted by law, fees are non-refundable once a billing period begins, except as required under the Australian Consumer Law (ACL) or as otherwise stated in our policy.

7. Shipping, returns & refunds (physical products)

  • Your ACL rights apply in addition to our policy.

8. Digital programs & content access

  • On purchase, you receive a personal, non-transferable licence to access the digital content for your own use.

  • No sharing, re-distribution or resale of programs, downloads, videos or member-only content.

  • For change-of-mind on digital products after access is granted, refunds aren’t available (ACL rights still apply).

9. Coaching, courses & services

  • Bookings can usually be rescheduled with at least 24 hours’ notice. Late cancellations or no-shows may be charged.

  • If a service does not meet guarantees under the ACL (due care and skill, fit for purpose), we’ll remedy it (e.g., re-delivery or refund) as required by law.

10. Your responsibilities & acceptable use

You agree not to:

  • Use the Services for unlawful, deceptive, infringing or harmful purposes.

  • Share login details, scrape or copy content, or bypass security features.

  • Upload or share content that is defamatory, hateful, harassing, obscene, or that violates others’ rights.
    We may suspend or terminate access for breaches.

11. Intellectual property

  • The Services and all content (programs, text, graphics, videos, logos) are owned by HRVfit or our licensors and are protected by Australian and international IP laws.

  • You receive a limited, revocable licence to use the Services for personal, non-commercial purposes. No other rights are granted.

12. User-generated content (UGC)

  • If you submit reviews, comments, progress stories, photos or videos, you grant HRVfit a worldwide, royalty-free licence to use, reproduce, edit and display that content in connection with the Services and our marketing (you can withdraw consent for future use by contacting us).

  • You must own or control the rights to anything you submit.

13. Testimonials & results

Testimonials represent the experiences of specific individuals. Results vary and are not guaranteed.

14. Third-party services & links

We may link to third-party sites, apps or tools. We don’t control or endorse third-party content and are not responsible for their practices. Use them at your own risk and review their terms and privacy policies.

15. Service availability & changes

We may modify, suspend or discontinue any part of the Services at any time. We’ll try to give reasonable notice for material changes where practical.

16. Australian Consumer Law (ACL)

Nothing in these Terms limits your non-excludable rights under the ACL. Where it is lawful to do so, and subject to the ACL:

  • Our liability for a breach of a consumer guarantee is limited to the resupply of the Services or the cost of resupplying the Services.

  • For goods, our liability is limited to the repair or replacement of the goods, or the cost of doing so.

17. Liability & risk

To the maximum extent permitted by law, HRVfit and its directors, employees and contractors are not liable for indirect or consequential loss, loss of profits, data, or opportunity arising from your use of the Services. You accept all risks associated with exercise and training.

18. Indemnity

You agree to indemnify HRVfit against losses, costs and liabilities arising from your breach of these Terms, your misuse of the Services, or your infringement of any rights of a third party.

19. Privacy & cookies

We handle personal information in line with our Privacy Policy, which explains what we collect, why, and how we use cookies/analytics.

20. Competitions & promos

From time to time we run promotions with additional terms. If there’s a conflict, those promo terms apply to that promotion.

21. Termination

We may suspend or terminate your access if you breach these Terms or we reasonably suspect unlawful or harmful activity. You may stop using the Services at any time. Clauses that by nature should survive, do survive (e.g., IP, disclaimers, limitations, indemnity).

22. Disputes

  • Step 1: Email us with details of your concern: {{support@hrvfit.com.au}}.

  • Step 2: We’ll try to resolve it in good faith within 14 days.

  • If unresolved, either party may pursue rights in a competent court.

23. Governing law

These Terms are governed by the laws of Victoria, Australia. The courts of Victoria have exclusive jurisdiction.

24. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on this page with the “Last updated” date. Continued use means you accept the changes.
